The next bill of rights

Six proposed amendments — each rooted not in ideology, but in what humanity now knows about human development, cognition, dignity, and our obligations to the living world. Nature already wrote these laws. We are proposing to codify them.

Proposed Amendment I

Cognitive Liberty

The right to a mind that is your own.

Proposed text

No person, corporation, algorithm, or government shall manipulate the cognitive processes of any individual without their full, informed, and revocable consent. This protection applies with particular force to persons under the age of neurological maturity.

What orcas teach us about the mind

Orca pods are among the most culturally sophisticated societies on Earth. Each pod speaks a dialect — a set of calls learned from mother to calf over years of close contact — that is unique to that family and passed down across generations. Researchers at the Center for Whale Research have documented that orca culture is not genetic. It is transmitted. A calf separated from its pod loses its dialect within months. The mind is not a fixed object. It is a living process shaped by the quality of its learning environment. When that environment is deliberately corrupted — by algorithmic manipulation, by systematic disinformation, by the exploitation of developmental vulnerabilities — the damage is not metaphorical. It is neurological.

Proposed Amendment II

Child Development

The right to a childhood that is actually complete.

Proposed text

Every child shall have a constitutionally guaranteed right to the developmental conditions necessary for full neurological maturation — including protection from exploitation, access to stable attachment relationships, and freedom from premature legal adulthood before the brain's executive systems have reached biological completion.

What elephants teach us about growing up

Elephant calves are born knowing almost nothing. Unlike many mammals, they cannot stand reliably for hours after birth. They require years — not weeks — of intensive community care before they can survive independently. Cynthia Moss's four-decade study of Amboseli elephants documented that calves raised without their mothers or grandmothers fail to learn the social knowledge — migration routes, water sources, threat recognition — that defines elephant survival. The knowledge is not in the genes. It is in the relationship. The human prefrontal cortex — the seat of judgment, impulse control, and long-range planning — does not reach full maturity until the mid-twenties. We are, neurologically, the most dependent species on Earth. Our law has not yet caught up to this fact.

Proposed Amendment III

Ecological Continuity

The right of future children to inherit a living world.

Proposed text

The United States recognizes an affirmative constitutional obligation to preserve the ecological conditions necessary for human flourishing across generations. No generation may consume, degrade, or destroy natural systems at a rate that forecloses the developmental rights of those not yet born.

How wolves change rivers — the trophic cascade of Yellowstone

What wolves teach us about cascades

When wolves were reintroduced to Yellowstone National Park in 1995 after a 70-year absence, the effects cascaded through the entire ecosystem in ways no one had predicted. Elk herds, no longer able to overgraze riverbanks without predation pressure, moved away from streams. Willows and aspens regenerated. Beavers returned. The beavers built dams. The dams created wetlands. The wetlands changed the hydrology of the rivers themselves — their courses shifted, their banks stabilized, their water ran cleaner. The wolves did not change the rivers directly. They changed the behavior of the elk, which changed the vegetation, which changed the water. Every species is a keystone for something. The children who will be born in 2075 have no vote in the decisions being made today. The Haudenosaunee Great Law of Peace required leaders to consider the impact of every decision on the next seven generations. That is not poetry. It is governance.

Proposed Amendment IV

Informational Integrity

The right to a learning environment that is not deliberately poisoned.

Proposed text

No entity shall systematically introduce false or misleading information into the public information environment with the intent to manipulate democratic deliberation, undermine scientific consensus, or exploit the cognitive vulnerabilities of developing minds. The right to accurate information is a precondition of meaningful liberty.

What dolphins teach us about learning

Bottlenose dolphins in Shark Bay, Australia, use marine sponges as tools — holding them over their rostrums to protect against abrasion while foraging on the seafloor. This behavior, documented by Janet Mann and colleagues, is not instinctive. It is learned. Mothers teach it to their calves over years of close observation. The behavior is cultural — it exists in some family lines and not others, and it disappears when the transmission is broken. What happens when the learning environment is deliberately corrupted? When the information a developing mind receives is systematically false? The dolphin calf that learns the wrong foraging technique from a corrupted teacher does not survive. The human child raised in an information environment designed to exploit rather than inform does not develop the cognitive tools for democratic self-governance. Informational integrity is not a media policy question. It is a developmental rights question.

Proposed Amendment V

Human Dignity

The right to be treated as a person, not a resource.

Proposed text

Every person possesses inherent dignity that no economic arrangement, legal classification, or institutional interest may override. Economic systems, corporate structures, and market mechanisms exist to serve human flourishing. When they fail to do so — and particularly when they exploit the developmental vulnerability of the young — they forfeit their claim to legal protection.

What bonobos teach us about cooperation

Bonobos and chimpanzees share approximately 98.7% of their DNA with humans — and with each other. Yet their societies are organized on radically different principles. Chimpanzee societies are organized around dominance hierarchies, competition, and the use of force. Bonobo societies are organized around cooperation, sharing, and the resolution of conflict through social bonding rather than violence. Frans de Waal's decades of research at the San Diego Zoo and in the Congo Basin documented that bonobo communities show lower rates of violence, higher rates of food sharing, and more stable social bonds than chimpanzee communities of comparable size. Nature ran this experiment. The cooperative model produces better outcomes for individuals and for the group. The question for human societies is not whether cooperation is possible — it is whether we will choose to build institutions that make it the default rather than the exception.

Proposed Amendment VI

Neuropsychological Integrity

The right to a brain that was not deliberately damaged.

Proposed text

No person, institution, or system shall subject any individual — and particularly any person under the age of neurological maturity — to practices, substances, or conditions known to produce preventable neurological or psychological harm. This protection applies to adverse childhood experiences, toxic stress, environmental neurotoxins, and institutional practices that exploit developmental vulnerability.

What humpback whales teach us about the learning window

The humpback whale's song is one of the most complex acoustic productions in the animal kingdom. Each breeding season, all the males in a population sing the same song — and that song evolves, year by year, as new phrases are introduced and old ones are dropped. The song is not genetic. It is learned. Researchers Roger Payne and Scott McVay, who first documented the song's structure in 1971, established that humpbacks learn their songs from other whales during a critical developmental window. A whale that misses this window — through isolation, injury, or environmental disruption — cannot acquire the full song. The learning window closes. The song is lost. The human brain has its own critical windows. The first three years of life are the most intensive period of synaptic development in human neurobiology. Adverse childhood experiences during this window — abuse, neglect, toxic stress, exposure to environmental neurotoxins — produce measurable, lasting changes to brain architecture that no subsequent intervention can fully reverse. This is not a social services question. It is a constitutional one.

These are not radical proposals.

They are the logical extension of what science has already established, what every major human tradition has already affirmed, and what nature has already demonstrated across 200 million years of mammalian evolution. The founders drew on the best science of their age — Newtonian mechanics, Lockean epistemology, Montesquieu's political theory. We are proposing to do the same with ours.
